01Who we are
LYVORIXA SOFT LLC (“LYVORIXA,” “we,” “us” or “our”) is a Missouri limited liability company. We provide the LYVORIXA website at lyvorixasoft.com, web application and iOS and Android apps (the “Service”). This Privacy Policy applies to personal information we process through the Service and when you contact us.
When a business uses the Service to store information about its own customers, drivers or crew, that business decides what to store and is responsible for its use. We process that information on the business’s behalf to provide the Service.
02Information we collect
Information you give us
- Account information: name, email address, phone number (optional), company name, password (stored in hashed form) and plan details.
- Business content you add: jobs, stops, addresses, appointment times, customer contact details, trip and job notes, income and expense entries, receipts and other documents you upload.
- Team information: names and email addresses of team members an account owner invites, and their roles.
- Communications: messages you send to support and your preferences for product emails.
Information collected automatically
- Device and usage data: IP address, browser and device type, operating system, app version, pages and features used, crash reports and log data, used to operate, secure and improve the Service.
- Precise location (optional): only if you turn on location permission for the app. See Location data below.
- Cookies: see Cookies and similar technologies below.
Information from third parties
- Payment processors and app stores: confirmation of payment, subscription status, and limited billing details such as card brand, last four digits, expiration date and billing ZIP or country. We never receive your full card number.
We do not ask for and you should not upload Social Security numbers, driver’s license numbers, bank account credentials or health information, except where a document you choose to store for your own records happens to include them.
03How we use information
We use personal information to:
- create and manage your account and provide the features you use, such as job and route planning, reminders, records, reports, document storage and sync;
- process subscriptions, renewals, cancellations and refunds, and send related receipts and notices;
- send service messages, such as reminders you set, security alerts and changes to our terms;
- respond to support requests;
- keep the Service secure, prevent fraud and abuse, and fix errors;
- understand how features are used in aggregate so we can improve them;
- send product news, only if you opt in, with an unsubscribe link in every message; and
- comply with legal obligations and enforce our terms.
We do not sell personal information, do not share it for cross-context behavioral advertising, and do not use it for targeted advertising. We do not use your business content to train third-party artificial intelligence models.
04Legal bases and consent
We process personal information on these bases, as applicable in your jurisdiction:
- Contract: to provide the Service you subscribe to.
- Consent: for optional precise location, push notifications, non-essential cookies (if we ever use them) and marketing emails. You can withdraw consent at any time in your device or account settings, or by contacting us. Withdrawing consent does not affect processing that already happened.
- Legitimate interests: to secure, maintain and improve the Service and communicate with customers, balanced against your rights.
- Legal obligation: to keep tax and transaction records and respond to lawful requests.
05Location data
Location access is optional and off by default. The app asks for permission through your device’s standard prompt, and you can allow, deny or change it at any time in your device settings. If you allow it, we use your location only to help you plan, view and estimate your own routes and stops, for example to start a route from where you are.
We do not collect location covertly, we do not offer hidden or background tracking of team members, and we do not sell, rent or share location data for advertising or with data brokers. Under some U.S. state laws precise geolocation is “sensitive personal information”; we use it only to provide the feature you requested.
06Cookies and similar technologies
Our website and web application use only cookies and similar storage that are strictly necessary, for example to keep you signed in, remember your settings, protect forms against abuse and balance server load. We do not use advertising cookies or third-party tracking pixels.
Our website loads some code libraries from a public content delivery network (CDN). When your browser requests these files, the CDN provider receives technical data such as your IP address and browser type, as needed to deliver them. If we ever add analytics or other non-essential cookies, we will update this policy and, where required, ask for your consent first.
You can block or delete cookies in your browser settings, but parts of the web application may not work without essential cookies. We honor Global Privacy Control (GPC) signals as a request to opt out of the sale or sharing of personal information; because we do not sell or share it, no further action is needed.
07How we share information
We share personal information only as described here:
- Service providers that process data for us under written contracts and only on our instructions, such as cloud hosting and storage, email delivery, push notifications, map and routing services, customer support tools, payment processors and app stores.
- Within your account: information you add may be visible to team members based on the roles and permissions the account owner sets.
- Legal reasons: when required by law, subpoena or court order, or to protect the rights, safety and property of our users, the public or LYVORIXA SOFT LLC.
- Business transfers: in connection with a merger, acquisition or sale of assets, in which case this policy will continue to apply to your information or you will be notified of any change.
- With your consent or at your direction.
08Payment processing
Subscriptions purchased on our website are processed by a third-party payment processor that is certified to the Payment Card Industry Data Security Standard (PCI DSS). Your card details go directly to the processor. LYVORIXA SOFT LLC does not receive or store full card numbers or security codes. The processor uses your information under its own privacy policy, including for fraud prevention.
Subscriptions purchased through the Apple App Store or Google Play are processed by Apple or Google, and their privacy policies apply to that payment information.
09Data retention
We keep personal information only as long as needed for the purposes in this policy:
- Account data and business content: while your account is active. After your subscription ends or you close your account, we keep it for 30 days so you can export it or reactivate, then delete it. Copies in encrypted backups are overwritten within a further 60 days.
- Billing and transaction records: as long as required by tax and accounting laws, generally up to 7 years.
- Server and security logs: generally up to 90 days, longer only if needed to investigate a security incident.
- Support emails: up to 2 years after the conversation ends.
If you ask us to delete your data, we do so sooner, except for information we must keep by law.
10Security
We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit (HTTPS/TLS), encryption at rest with our hosting providers, hashed passwords, access controls limited to staff who need access, and regular backups. No system is perfectly secure. If a data breach affects your personal information, we will notify you and any authorities as required by law. Please use a strong, unique password and tell us right away if you suspect unauthorized access.
11Your choices and rights
Wherever you live, you can:
- view and update most account information in your account settings;
- export your business content (for example, CSV reports and uploaded documents);
- ask us for a copy of your personal information, or to correct or delete it;
- turn location and notifications on or off in your device settings; and
- unsubscribe from marketing emails at any time. Service messages, such as receipts and security notices, will still be sent.
12U.S. state privacy rights
Residents of California and other states with consumer privacy laws, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon and others, may have the following rights, subject to legal exceptions:
- Right to know and access the categories and specific pieces of personal information we have collected, the sources, the purposes and the categories of recipients;
- Right to delete personal information we collected from you;
- Right to correct inaccurate personal information;
- Right to data portability, to receive your information in a usable format;
- Right to opt out of the sale of personal information, sharing for cross-context behavioral advertising, targeted advertising and profiling with legal or similarly significant effects. We do none of these;
- Right to limit the use of sensitive personal information. We use precise geolocation only to provide the feature you asked for;
- Right to non-discrimination: we will not deny service, charge different prices or provide a different quality of service because you exercised your rights; and
- Right to appeal a decision we make about your request, by replying to our decision email with the subject “Privacy appeal.”
Categories collected in the last 12 months (California Consumer Privacy Act terms): identifiers (name, email, IP address); customer records and commercial information (company, plan, transaction history); internet or network activity (usage and log data); precise geolocation (only if enabled); professional information (company and role); and other content you choose to store. Sources: you, your devices, your account owner, and our payment processors and app stores. Purposes and recipients are described above.
We have not sold personal information and have not shared it for cross-context behavioral advertising in the past 12 months, and we have no actual knowledge of selling or sharing personal information of consumers under 16.
You can use an authorized agent to make a request. We may ask the agent for proof of authorization and ask you to verify your identity.
13Access and deletion requests
To make a privacy request, including a request to delete your data:
- email privacy@lyvorixasoft.com from the email address on your account and tell us what you would like us to do; or
- use the “Delete account” option in your account settings in the web app or mobile app.
We will verify your request, usually by confirming control of your account email, and respond within 45 days. If we need more time, up to a further 45 days where the law allows, we will tell you why. Once a deletion request is verified, we delete your account and business content within 30 days, and backup copies are overwritten within a further 60 days, except information we must keep by law, such as billing records.
If you are a team member of another company’s account, we may refer your request to that account owner, who controls the business content, and we will help them respond.
14Children's privacy
The Service is intended for adults using it for business purposes and is not directed to children under 13. We do not knowingly collect personal information from children under 13, consistent with the Children’s Online Privacy Protection Act (COPPA). You must be at least 18 to create an account. If you believe a child has provided personal information to us, contact privacy@lyvorixasoft.com and we will delete it.
15Where data is processed
LYVORIXA SOFT LLC is based in the United States, and the Service is intended for users in the United States. Your information is processed and stored in the United States, where data protection laws may differ from those in your country. If you use the Service from outside the United States, you understand that your information will be transferred to and processed in the United States.
Our website may link to third-party sites, such as app stores. Their privacy practices are governed by their own policies.
16Changes to this policy
We may update this Privacy Policy as the Service or the law changes. We will post the updated policy here and change the effective date above. If we make a material change, we will notify you by email or in the app before it takes effect, and we will ask for your consent where required by law.
